Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was held in immigration custody.

In her order, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings center on disputed claims. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
